Please read these Terms and Conditions ("Terms") carefully before using meritoshop.co.uk (the "Website"), operated by High Mobile Accessories ("we", "us", "our"), an online retailer of mobile phone cases and accessories. By accessing the Website or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Website.

2. Definitions

  • "Contract" means the legally binding agreement between you and us for the supply of Products.

  • "Products" means the phone cases, covers, screen protectors, and related accessories advertised for sale on the Website.

  • "Personalised Product" means any Product customised or printed to your specification (e.g., custom photo, name, or design case).

  • "Order" means your request to purchase Products from us.

  • "We/Us/Our" refers to High Mobile Accessories.

  • "You/Your" refers to the customer using the Website or placing an Order.

3. Eligibility and Use of the Website

3.1. You must be at least 18 years old to place an Order, or have the consent of a parent or guardian.

3.2. You agree to use the Website only for lawful purposes and not in any way that infringes the rights of, or restricts or inhibits the use of, the Website by anyone else.

3.3. You are responsible for keeping any account login details confidential and for all activity under your account.

3.4. We reserve the right to suspend or terminate your access to the Website if we reasonably believe you have breached these Terms.

4. Products

4.1. Device compatibility. It is your responsibility to select the correct phone case for your exact device make and model. We list compatible models clearly on each product page. We are not liable for cases ordered for the wrong device model due to customer error, though we're happy to help you exchange it (see Section 10).

4.2. Colour and material accuracy. We make reasonable efforts to display Products, including colours, textures, and finishes, as accurately as possible. Actual colour may vary slightly due to screen display settings and lighting during photography.

4.3. Protective claims. Where a Product is described as offering drop, shock, or scratch protection (e.g., "military-grade", "shockproof", "raised bezel"), this is based on manufacturer testing or industry-standard drop tests and is not a guarantee against damage in all circumstances. No case can guarantee against all forms of device damage.

4.4. All Products are subject to availability. If a Product you have ordered becomes unavailable, we will notify you and provide a full refund for that item.

4.5. We reserve the right to modify, discontinue, or update Product designs (e.g., seasonal or limited-edition cases) without notice.

5. Personalised and Custom Cases

5.1. Where you order a Personalised Product (e.g., a case featuring your own photo, text, or custom design), you are responsible for:

  • Ensuring uploaded images and text are your own or that you have the right to use them;

  • Checking spelling, layout, and image quality before submitting your Order, as we print based on the file/text you provide;

  • Ensuring content is not offensive, unlawful, or infringing on third-party rights (including copyright and trademarks, such as unlicensed use of copyrighted characters, logos, or celebrity images).

5.2. We reserve the right to refuse to print or fulfil any personalisation request that we consider inappropriate, offensive, or unlawful, and to cancel the Order with a full refund.

5.3. Right to cancel does not apply to Personalised Products once production has started, as these are made to your specification (see Section 8.5).

5.4. If a Personalised Product arrives faulty, misprinted (not matching your submitted design), or damaged, your statutory rights under Section 9 still apply in full.

6. Pricing and Payment

6.1. All prices are listed in GBP (£) and are inclusive of UK VAT where applicable, unless stated otherwise.

6.2. Prices, including bundle and multi-buy discounts, are subject to change, but changes will not affect Orders already confirmed.

6.3. Delivery charges, if applicable, are shown separately at checkout.

6.4. We accept payment via STRIPE, with credit/debit card, PayPal, Apple Pay, Google Pay, Klarna. Payment is taken at the time of Order.

6.5. In the unlikely event a Product is listed at an incorrect price due to a typographical or system error, we reserve the right to cancel the Order and refund any payment made, even after an Order confirmation has been sent.

6.6. We use Stripe/PayPal/PaySera to process payments securely. We do not store your full card details on our servers.

7. Order Process and Contract Formation

7.1. When you place an Order, you will receive an order acknowledgement by email. This does not constitute acceptance of your Order.

7.2. A legally binding Contract is formed only when we send you a Dispatch Confirmation email confirming your Products have been sent.

7.3. We reserve the right to refuse or cancel any Order, including for reasons such as Product unavailability, pricing errors, suspected fraud, or inappropriate personalisation content.

8. Delivery

8.1. We aim to dispatch Orders within 1 business days, with standard UK delivery typically taking 2–3 business days. Personalised Products may take longer to produce and dispatch — estimated production times are shown at checkout.

8.2. Delivery times are estimates only and not guaranteed.

8.3. Risk in the Products passes to you upon delivery. Ownership passes once we have received payment in full.

8.4. If no one is available to receive delivery, our courier's standard policy will apply (e.g., safe place, neighbour delivery, or collection point). Replace with royal mail delivery policy

8.5. We are not liable for delays outside our reasonable control (see Section 14, Force Majeure).

8.6. International delivery: Our aim is to deliver Worldwide with exception for countries listed by Royal Mail.

9. Your Right to Cancel (Cooling-Off Period)

9.1. If you are a consumer purchasing from within the UK, you have the right to cancel your Order within 14 days of receiving the Products, without giving any reason.

9.2. To cancel, you must inform us clearly by email before the 14-day period expires.

9.3. You must return the Products to us within 14 days of notifying us of cancellation, at your own cost, unless the Products are faulty or not as described.

9.4. Once we receive the returned Products, we will refund you within 14 days using the original payment method, including standard delivery charges (excluding any premium delivery upgrade you chose).

9.5. Products must be unused and undamaged, in their original packaging, so they can be resold. We may make a deduction from your refund if a case shows signs of use beyond simply checking fit and appearance (e.g., scratches, rip or remove the seal, finger prints and other marks on the case, the box is unusable condition).

9.6. The right to cancel does not apply to:

  • Personalised or custom-designed Products made to your specification (see Section 5.3);

  • Screen protectors, tempered glass, or other Products once their protective seal/packaging has been opened, for hygiene and application-integrity reasons, unless faulty;

  • Any Product where the seal has been broken and it is unsuitable for return on health or hygiene grounds.

10. Damaged, Used, or Misused Returns

10.1. Under the Consumer Contracts Regulations 2013, you may inspect a Product as you would in a physical shop before deciding to return it. This does not extend to using, wearing, fitting, or testing the Product beyond reasonable inspection.

10.2. If a returned Product is found to be damaged, marked, altered, or shows signs of use or misuse beyond what is necessary to establish its nature, characteristics, and function, we reserve the right to:

  • Make a deduction from your refund reflecting the reduction in the Product's value; or

  • Decline the refund entirely where the Product cannot be resold due to the damage or its condition, and instead return the Product to you at your cost.

10.3. Examples of damage or misuse that may result in a reduced or declined refund include, but are not limited to: cracked, cut, scratched, or forcibly bent cases; screen protectors removed from their backing and applied to a device; missing components or packaging; or visible signs that the Product has been dropped, impacted, or subjected to force.

10.4. This clause does not affect your rights where a Product is genuinely faulty or defective on arrival (see Section 12). We reserve the right to request photographs of the Product and its condition, and in some cases the returned item itself, before processing any refund or replacement, in order to assess whether an issue is a manufacturing fault or the result of customer use or damage.

10.5. Where we reasonably believe a claimed fault is inconsistent with the nature of the reported issue (for example, damage that appears to result from impact or force rather than a material or manufacturing defect), we may decline to treat the claim as a fault under the Consumer Rights Act 2015 and instead treat it under this Section 10.

11. Wrong Item, Wrong Model, or Change of Mind

11.1. If you've ordered the wrong phone model or simply changed your mind, you can return an unused, unopened Product within 14 days under Section 9 above.

11.2. To exchange for the correct model, contact us by email, contact@meritoshop.co.uk — we're happy to arrange an exchange, though return postage for customer-error orders is at your own cost unless we made the error.

12. Faulty, Damaged, or Incorrect Products

12.1. We are under a legal duty to supply Products that are as described, fit for purpose, and of satisfactory quality.

12.2. If a Product is faulty, damaged in transit or not as described:

  • Within 30 days of purchase, you are entitled to a full refund.

  • Within 6 months, you are entitled to a repair or replacement (or a refund if this isn't possible).

  • After 6 months, you may still have rights, but you may need to show the fault existed at the time of delivery.

12.3. To report an issue, contact us at contact@meritoshop.co.uk with your order number and a photo showing the fault or damage (e.g., cracked case, misaligned print, peeling material).

12.4. Nothing in these Terms affects your statutory rights as a consumer.

13. Returns and Refunds Process

13.1. To start a return, contact us at contact@meritoshop.co.uk with your order number.

13.2. Refunds are issued to the original payment method within 14 days of us receiving the returned item or valid proof of return postage.

13.3. Return postage is the customer's responsibility unless the Product is faulty, damaged, or incorrect.

13.4. We recommend using a tracked delivery service for returns; we're not responsible for items lost in transit back to us.

14. Intellectual Property

14.1. All content on the Website — including text, graphics, logos, photography, and case designs (excluding customer-submitted personalisation content) — is the property of High Mobile Accessories or its licensors and protected by UK and international copyright and trademark law.

14.2. You may not reproduce, distribute, or use any Website content for commercial purposes without our prior written consent.

14.3. Any designs, artwork, or branding on our Products are either originally created, licensed, or used with permission. Unauthorised copying of our designs is prohibited.

15. Liability

15.1. Nothing in these Terms limits or excludes our liability for:

  • Death or personal injury caused by our negligence;

  • Fraud or fraudulent misrepresentation;

  • Any liability that cannot be excluded or limited under English law.

15.2. Subject to Clause 14.1, we are not liable for indirect or consequential loss, including damage to your phone or device, except where such damage results directly from our negligence or a proven manufacturing defect in the Product.

15.3. Our total liability to you for any claim arising from the Contract shall not exceed the total amount paid by you for the relevant Order.

15.4. We are not liable for failure or delay in performing our obligations where this results from causes beyond our reasonable control.

16. Force Majeure

We are not liable for any failure or delay in performance resulting from events beyond our reasonable control, including natural disasters, strikes, transport or courier disruption, pandemic, or governmental action.

17. Privacy and Data Protection

17.1. We process your personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

17.2. Where you upload photos or personal images for a Personalised Product, these are used solely to produce your order and are handled in line with our Privacy Policy.

18. Complaints

If you're unhappy with any aspect of our service, please contact us at contact@meritoshop.co.uk and we'll do our best to resolve the issue. If we can't resolve a dispute directly, you may be entitled to use the UK-based Alternative Dispute Resolution (ADR) provider [RELEVANT ADR SCHEME, if applicable].

19. Changes to These Terms

We may update these Terms from time to time to reflect changes in law or business practice. The updated Terms will be posted here with a revised "Last updated" date. Continued use of the Website after changes constitutes acceptance of the new Terms.

20. Severability

If any provision of these Terms is found invalid or unenforceable by a court, the remaining provisions continue in full force and effect.

21. Entire Agreement

These Terms, together with our Privacy Policy and any other referenced documents, constitute the entire agreement between you and us regarding your use of the Website and purchase of Products.

22. Governing Law and Jurisdiction

21.1. These Terms are governed by and construed in accordance with the laws of England and Wales.

21.2. Any disputes arising out of or in connection with these Terms are subject to the exclusive jurisdiction of the courts of England and Wales, save that consumers resident elsewhere in the UK may also bring proceedings in their local courts.
